Welcome to Fitness App. These Terms of Use ("Terms") govern your access to and use of the Fitness App mobile application and any related services (collectively, the "Service") provided by the operator ("we", "our", or "us"). Please read them carefully.
By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to create an account. By using the Service you represent that you meet this requirement, that the information you provide is accurate, and that your use of the Service does not violate any applicable law or regulation.
Account & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorised access. We may suspend or terminate accounts that we reasonably believe are compromised or being used in violation of these Terms.
Permitted Use
You may use the Service only for lawful, personal, non-commercial purposes. You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use automated tools (bots, scrapers) to access the Service or interfere with its operation.
- Upload or transmit content that is unlawful, infringing, defamatory, or abusive.
- Resell, sublicense, or redistribute any part of the Service without our written permission.
- Circumvent any access controls, rate limits, or security mechanisms.
Health Disclaimer
The Service is for informational and motivational purposes only and is not medical advice. Consult a qualified healthcare professional before starting any new exercise program, particularly if you have a medical condition, are pregnant, are recovering from injury, or take medication.
Recommended programs, generated workouts, exercise selections, weights, sets, repetitions, rest periods, and any progress or heart-rate analysis presented in the Service are produced algorithmically. They are not personalised medical or training prescriptions. Stop exercising and seek medical attention immediately if you feel pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptom. You assume all risk associated with physical activity performed using the Service.
User Content
"User Content" means any data you submit to the Service, including profile fields, custom programs, body measurements, progress photos, notes, and ratings. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely to provide the Service to you. We do not use User Content for advertising and do not sell it to third parties.
You are solely responsible for the legality and accuracy of your User Content. Do not upload content that infringes a third party’s rights or violates applicable law.
Subscriptions & Purchases
Some features may require a paid subscription. Purchases are processed by the platform store (Apple App Store or Google Play) and are governed by that store’s terms. Subscription pricing, billing, renewal, and refund rules are administered by the store; consult your platform settings to manage or cancel a subscription.
Intellectual Property
The Service, including its source code, design, logos, exercise database, and content (excluding User Content), is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.
Third-Party Services
The Service relies on third-party providers (for example, Google Firebase, Apple HealthKit, Apple Sign-In, Google Sign-In, push-notification services, and IP-geolocation lookups). Use of these providers is subject to their own terms, and we are not responsible for their acts or omissions. The Service may also link to or display content from third parties; we do not endorse and are not responsible for that content.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, created risk for us or other users, or if we discontinue the Service. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, governing law) will survive.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY SPECIFIC FITNESS OUTCOME WILL BE ACHIEVED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS OR (B) USD 50.
Some jurisdictions do not allow certain warranty exclusions or liability limitations; in those jurisdictions, the above limitations apply only to the extent permitted.
Indemnification
You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising out of (i) your User Content, (ii) your violation of these Terms, or (iii) your violation of any third-party right or applicable law.
Governing Law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. The competent courts of Istanbul, Türkiye, will have exclusive jurisdiction over any dispute arising under these Terms, except where mandatory consumer-protection laws of your country of residence provide otherwise.
Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be communicated through the Service. By continuing to use the Service after a revision takes effect, you agree to the updated Terms.
